Former Inland Revenue chair to lead NCVO tax review group

Sir Nicholas Montagu will lead the umbrella group’s Charity Tax Commission, which will include five other commissioners and is set to review the tax system as it affects the sector

A former chairman of the Inland Revenue will lead a group set up by the National Council for Voluntary Organisations to make recommendations to government on how it might reform the charity tax system.

Sir Nicholas Montagu, who chaired the Inland Revenue between 1997 and 2004, shortly before it merged with HM Customs & Excise to become HM Revenue & Customs, will lead the NCVO’s Charity Tax Commission, the umbrella body has announced.

The commission, which was announced earlier this year, will carry out a full review of the charity tax system and the estimated £3.7bn worth of charity tax reliefs, then submit recommendations for reform to the government.

Montagu will be supported by five commissioners who have experience of the charity sector or fiscal policy.

They are: Sarah Atkinson, director of policy, planning and communications at the Charity Commission; Dan Corry, chief executive of the think tank New Philanthropy Capital; Pesh Framjee, head of not-for-profits at Crowe Clark Whitehill and a special adviser to the Charity Finance Group; Clare Pelham, chief executive of the Epilepsy Society; and Lynne Oats, professor of taxation and accounting at the University of Exeter Business School and co-director of the university’s Tax Administration Research Centre.

The Treasury and HM Revenue & Customs will also attend the commissioner as observers, and another commissioner might be announced shortly, the NCVO said.

The commission will meet for the first time later this week and should complete its work in the next 18 months, with the aim of informing the Inquiry Into the Future of Civil Society, which is chaired by Julia Unwin and is expected to report in 2019.

The tax commission is the first comprehensive review of charity tax since 1997, according to Montagu.

“My aspiration is for the commission’s proposals to inform future changes to the tax system such that it can continue to support charities’ work as effectively as possible,” he said.

“I look forward to drawing up pragmatic proposals that will appropriately balance the need for a fair and efficient tax system with the important role that we want charities to continue to play in society.”

In response to the NCVO’s announcement, Caron Bradshaw, chief executive of the CFG, said: “This commission comes at a critical time for our sector and carries a heavy weight of responsibility. We believe the commission should ensure that the proposals it puts forward deliver significant positive change for charities.

“We urge it to be brave and bold; now is not the time for tinkering. We have long argued that the tax bill for our sector is too high, and we look forward to hearing how the commission proposes this burden can be reduced.”

John Hemming, chair of the Charity Tax Group, said the commission “offers a further opportunity to challenge the anomalous tax position charities often find themselves in, particularly in respect of VAT”.

He said: “It is essential that charity tax reliefs keep up with societal and technological developments, or they may become obsolete. We look forward to working with the commission and recommend that future-proofing tax reliefs for charities be one of its major areas of focus.”

Sacked British Council manager loses employment tribunal case

Angela Gibbins was dismissed from her role as head of global estates in August last year after making comments about the royal family on a Facebook post

A former senior manager at the British Council who was sacked over anti-monarchy comments on a Facebook post that described Prince George as “a f***ing d***head” has lost her employment tribunal claim for wrongful dismissal and discrimination.

Angela Gibbins was dismissed from her £77,800-a-year job as head of global estates at the British Council on 8 August 2016, after comments she had made on Facebook criticising the monarchy and Prince George appeared in The Sun newspaper, causing a backlash against her and the charity.

The Queen is the patron of the British Council, which had an income of £979.6m in the year to 31 March 2016.

An image of Prince George was posted by the band the Dub Pistols on its Facebook page, with the caption “I know he’s only 2 years old, but Prince George already looks like a f***ing d***head”. The band added: “Too much?”

In a discussion with friends underneath the picture, which Gibbins said she believed was visible only to her 150 Facebook friends, Gibbins commented: “White privilege. That cheeky grin is the (already locked-in) innate knowledge that he is royal, rich, advantaged and will never know *any* difficulties or hardships in life. Let’s find photos of 3yo Syrian refugee children and see if they look alike, eh?”

She went on to say she did not hate any human being, but added: “I don’t believe the royal family have any place in a modern democracy, least of all when they live on public money.”

Tribunal papers published last week say it was unclear how the comments came into the public domain, but they might have been passed on by one of Gibbins’ friends or been visible to friends of friends.

The Sun’s initial coverage of the comments failed to make clear that Gibbins herself was not responsible for the obscene remark about Prince George in the picture’s caption, and provoked outrage against the charity and calls for Gibbins to be sacked.

An internal British Council investigation into the incident concluded that Gibbins had, although inadvertently, breached the council’s code of conduct in making the comments and brought the charity into disrepute, according to the tribunal papers.

Gibbins took the charity to tribunal, arguing that she had been discriminated against because of her republican beliefs and had been unfairly or wrongfully dismissed.

But the tribunal, which heard the case in July, rejected her claims, concluding there had been “reckless risk-taking” and “gross misconduct” by Gibbins in posting the comments.

The tribunal document says it concluded Gibbins was seen to have bought the charity into disrepute and sacked not because she expressed a republican belief, but because “she had associated herself with a distasteful and personal attack on a small child”.

The tribunal report says that, although an employer might have chosen to discipline Gibbins without sacking her, no member of the tribunal could say it was unreasonable to dismiss her.

“Clearly the claimant deserves some sympathy for her slip of judgment, but that does not mean the decision was unfair,” the report says.

A British Council spokeswoman said: “While we recognise the difficult nature of this process for all involved, we are pleased that the tribunal has found in our favour in relation to all of the claims. The British Council looks to act with integrity and respect in all that we do to promote the UK and our position in the world.”

We must debate charging for regulation, says Charity Commission chief

In a blog, Helen Stephenson says that pressure on the regulator’s funding means that, though the debate will be heated, it must happen

The Charity Commission is expected to propose asking the largest 2,000 charities in England and Wales to contribute a total of about £7m a year to boost the regulator’s resources and help it increase the support it provides to trustees, its chief executive has indicated.

In a blog post published by the commission today, Helen Stephenson says that although she expects the debate with the sector over charging charities to be a heated one, it must be had.

The commission’s suggestion that it would charge charities for its services have already been opposed by some charity umbrella bodies, with the charity leaders body Acevo, the Charity Finance Group, the Small Charities Coalition and the local infrastructure body Navca setting out their opposition to what they called a “charity tax” in a letter to the Treasury last month.

Stephenson says in her blog today that in the three months since she started as chief executive of the regulator the pressure on its finances are one of two main areas she wants to address in the years ahead – the other being improving its services for trustees.

She says the commission’s budget – which is frozen at £20.3m a year until 2020 – has halved in real terms since 2007, while applications for charity registrations have increased by 40 per cent over the past four years.

If the regulator is to continue to prioritise the issues and cases presenting the highest risks to charities and to public trust, then its ability to deal with lower-risk work will decline and the service it provides to charities could become slower, says Stephenson.

She says she is making the case to government for transitional funding to help it bridge the gap between the regulator’s funding and the “significant increase in demand on our services”.

But she says that the context of continued pressure on public finances and the regulator’s desire to provide more support for trustees has led her to conclude that the commission “must start a sensible, open debate about larger charities making a modest contribution to the cost of parts of their regulation”.

Stephenson says work on charging proposals is at an early stage, “but our current thinking is that in order to improve our existing services and develop new services for trustees, we would need to raise in the region of £7m annually from the largest 2,000 charities on our register”, which is likely to be on a sliding scale according to each charity’s annual income.
